Asset Protection

We counsel clients how best to structure their assets to reduce the risk of loss during their lifetimes.  We:
  • Counsel physicians and other professionals engaged in careers with a strong likelihood of an eventual lawsuit how to protect assets from potential creditors through the use of Delaware Trusts, joint titling, and other protective devices;
  • Establish Asset Protection Trusts for families seeking to protect assets against the costs of long-term care;
  • Establish Supplemental Needs Trusts to provided additional sources of support for elderly and disabled individuals to ensure that Medicaid and other government entitlements remain available;
  • Facilitate transfers of residences while retaining life use for the original owner;
  • Help families qualify for Medicaid coverage of long-term care expenses, whether home-based or nursing-home-based, while preserving the individual’s assets to the maximum extent possible;
  • Complete Medicaid applications to ensure that an individual in need of long-term care receives the benefits to which he or she is entitled.

Trust and Estate Administration

We assist trustees, executors, administrators, and beneficiaries with the administration of trusts and estates by:
  • Petitioning for Letters Testamentary, Letters of Administration, Letters of Trusteeship, Probate, Administration, Ancillary Probate, and Ancillary Administration;
  • Probating and administering estates;
  • Counseling trustees with respect to their fiduciary responsibilities in administering trusts;
  • Counseling beneficiaries with respect to their rights as set forth in trusts and Wills;
  • Counseling clients with respect to assets that do not pass through a decedent’s estate, such as jointly-titled assets, assets held in trust for the benefit of the decedent, life insurance policies, and qualified retirement plans (IRAs, 401(k)s, 403(b)s);
  • Post-mortem planning to optimize tax consequences through the use of disclaimers and renunciations.

Tax Planning

We counsel our clients with respect to the gift, estate, income, capital gains, and other tax consequences associated with the planning and administration of their trusts and estates.  We handle highly complex tax issues and are equipped to litigate contested tax matters against the New York State Department of Taxation and Finance and the Internal Revenue Service.

Trusts and Estates Litigation
